1. Acceptance of Terms

By accessing or using Harlequin Chat, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the service.

2. Description of Service

Harlequin Chat provides a free AI chat service using Large Language Models (LLMs). The service allows users to interact with an AI assistant through text-based conversations. We also provide an API for programmatic access to the chat functionality.

3. Use of Service

You agree to use Harlequin Chat only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the service to send spam, unsolicited content, or harmful data.
• Interfere with or disrupt the integrity or performance of the service.
• Attempt to circumvent rate limits or access restrictions.
• Use automated methods to access the service at a rate that could damage or overload our systems.
• Use the service to generate content that is harmful, offensive, discriminatory, or illegal.
• Resell, redistribute, or offer our service to others without our explicit permission.

4. Intellectual Property

Harlequin Chat and its original content, features, and functionality are and will remain the exclusive property of Harlequin Chat and its licensors. You may not duplicate, copy, or reuse any portion of the HTML/CSS, JavaScript, or visual design elements or concepts without express written permission.

The content you generate or receive through Harlequin Chat (text output from conversations) may be used by you for personal or commercial purposes, with acknowledgment that it was generated with assistance from an AI service.

5. Rate Limiting and Fair Usage

To ensure fair access to our service for all users, we implement rate limiting. Currently, this is set at a 3-second interval between messages. Attempting to circumvent these limits may result in temporary or permanent suspension of your access to the service.

6. Disclaimer of Warranties

Harlequin Chat is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the service will always be available, uninterrupted, timely, secure, or error-free.

The AI generates responses based on patterns learned during training and may sometimes provide inaccurate or inappropriate information. You should verify important information and use your judgment regarding the content provided.

7. Limitation of Liability

In no event shall Harlequin Chat be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the service.

8. Changes to Terms

We reserve the right to modify or replace these Terms at any time. It is your responsibility to check the Terms periodically for changes. Your continued use of the service following the posting of any changes to the Terms constitutes acceptance of those changes.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of California, USA, without regard to its conflict of law provisions.
